Step 1: Free Consultation

Your journey begins with completing a simple intake form that assist us with understanding your situation. Then at your complimentary consultation we'll discuss your situation, answer your questions, and explain how the mediation process works. This meeting is an opportunity to determine whether mediation is the right fit for your family, review the next steps, discuss pricing, and help you move forward with confidence and clarity. If you're ready for the next step, we provide you with the right resources, including our exclusive workbook.

Your Next Chapter Workbook

At Fehn Divorce Mediation, we believe that an organized process leads to better decisions and less stress. That's why every client receives The Next Chapter Workbook™— a comprehensive organizer designed to guide you through each step of the mediation process. The portfolio includes personalized checklists, document requests, financial worksheets, timelines, important forms, and dedicated sections to organize your records in one convenient place. Rather than wondering what comes next, you'll have a clear roadmap that keeps you informed and focused throughout your mediation journey.

Step 2: Initial Mediation Meeting

Both spouses meet with the mediator to review The Next Chapter Portfolio, discuss the mediation process, outline their goals, and review the required checklists, forms, and supporting documents. During this meeting, information is gathered, questions are answered, and the foundation is established for productive mediation sessions. Whenever possible, spouses are encouraged to attend together so mediation sessions can be scheduled and the process can begin efficiently.

Step 3: The Mediation Sessions

Most couples reach a full resolution in two to four mediation sessions, depending on the complexity of their circumstances and the issues to be resolved. During each session, we work collaboratively through topics such as parenting plans, child and spousal support, property division, and financial matters. The pace is tailored to your family's needs, allowing both spouses the time and guidance needed to make informed decisions and reach practical, lasting agreements.

Step 4: Drafting and Finalizing Your Agreement

Once all issues have been resolved, your agreements are carefully documented in a comprehensive written settlement agreement. You and your spouse will have the opportunity to review the draft, request any necessary revisions, and ensure the terms accurately reflect your decisions. Once finalized, the agreement can be used as part of the divorce filing process, providing a clear path toward completing your divorce with confidence.

Step 5: Filing Your Divorce Documents

Once your settlement agreement is finalized, a Legal Document Assistant (LDA)* will assist with preparing and filing the required court documents. The LDA will help ensure the paperwork is completed accurately and submitted to the court, making the filing process as smooth and efficient as possible while allowing you to move toward finalizing your divorce.

California’s 6-Month Waiting Period

One important factor affecting the timing of a California divorce is the mandatory six-month waiting period. This period begins when the divorce petition and summons are served not when mediation is completed. Even if all issues are resolved quickly through mediation, the court cannot finalize the divorce until at least six months have passed from the date of service.
